This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from namaclo.com (the "Site"), or when you use our creator partner portal at creators.namaclo.com (the "Partner Portal").
When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse, we collect information about the pages and products you view, what websites or search terms referred you to the Site, and how you interact with the Site. We refer to this as "Device Information."
We collect Device Information using:
Cookies — data files placed on your device that often include an anonymous unique identifier. For more information about cookies and how to disable them, visit allaboutcookies.org.
Log files — which track actions on the Site and collect data including IP address, browser type, internet service provider, referring/exit pages, and timestamps.
Web beacons, tags, and pixels — electronic files used to record how you browse the Site, including the Meta (Facebook) pixel and Google Analytics tags.
When you make (or attempt to make) a purchase, we collect your name, billing address, shipping address, payment information, email address, and phone number. We refer to this as "Order Information."
Text marketing and notifications: By subscribing to text notifications you agree to receive recurring automated marketing messages at the phone number provided. Consent is not a condition of purchase. Reply STOP to unsubscribe, HELP for help. Message and data rates may apply.
We use Order Information to fulfill orders placed through the Site (processing payment, arranging shipping, and providing invoices and order confirmations), to communicate with you, to screen orders for potential risk or fraud, and — in line with the preferences you have shared with us — to provide you with information or advertising relating to our products.
We use Device Information to help screen for potential risk and fraud (in particular, your IP address), to improve and optimize the Site (for example, by generating analytics about how customers browse and interact with the Site), to assess the success of our marketing campaigns, and to deliver targeted advertising and retargeting through platforms such as Meta and Google (see "Behavioral advertising" below).
If you are a creator, influencer, or brand partner using the Partner Portal — or if you receive a gift or product seeding invitation from us — this section describes the additional information we collect from you and how it is used.
Account and contact information: your name, email address, password (for your account login), and, if you provide them, your phone number and mailing address.
Gift and shipping information: if you accept a gifted product invitation, your name, email, phone number, and full shipping address, along with your product and size selections.
Payment information: the details required to pay you, depending on the payout method you choose — your PayPal or Interac e-Transfer email, or bank transfer details (account holder name, financial institution, routing/transit and account numbers, and, for international wires, beneficiary and bank address and SWIFT/BIC). Payment details are protected with appropriate safeguards, including encryption.
Partnership and performance data: your affiliate code and code change requests, sales and commission data attributable to your code, campaign confirmations and notes, product feedback, and — where you have granted whitelisting/partnership ad permissions through Meta — advertising performance data (such as spend, impressions, and engagement) for ads run with your handle.
Content you submit: videos, photos, related notes, and links to your existing social posts.
Portal usage data: log information similar to the Device Information described in Part A.
We use this information to operate the partner program: managing your account, shipping product to you, tracking sales and commissions attributable to you, calculating payouts and paying you (payments are sent via PayPal, bank transfer, or Interac e-Transfer; we do not process payments through the Portal itself), running and measuring partnership advertising, reviewing and using content you submit in accordance with your partner agreement, communicating with you about campaigns and opportunities, and meeting our accounting and legal obligations.
Content you upload for campaigns is stored and processed with third-party media services so that our team and advertising platforms can access it for review and campaign use. Usage rights for your content are governed by your partner agreement.
We use trusted third-party service providers to operate the Partner Portal, and your information is processed by them on our behalf. These include providers of hosting, database and account authentication, file and video storage, and email delivery, as well as Shopify (discount codes and order attribution) and Meta Platforms (advertising and ad performance data). Each provider processes data only as needed to provide its service to us.
Your information may be transferred to and stored in Canada and the United States.
We share Personal Information with third parties to help us use it as described above. For example, we use Shopify to power our online store (see shopify.com/legal/privacy) and Google Analytics to understand how customers use the Site (see google.com/policies/privacy; opt out at tools.google.com/dlpage/gaoptout).
We may also share Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.
We do not sell your personal information.
We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Please note that we do not alter the Site's data collection and use practices when we see a Do Not Track signal from your browser.
Depending on where you live, you may have rights to access the personal information we hold about you and to ask that it be corrected, updated, or deleted.
Canada (PIPEDA): You may request access to or correction of your personal information, or withdraw consent to its use, subject to legal and contractual restrictions.
European residents (GDPR): You have the right to access, correct, update, or request deletion of your personal information. We process your information to fulfill contracts we may have with you (for example, an order placed through the Site or a partnership agreement) or to pursue the legitimate business interests described above. Your information will be transferred outside of Europe, including to Canada and the United States.
United States residents: Depending on your state, you may have additional rights regarding your personal information under applicable state privacy laws.

When you place an order through the Site, we retain your Order Information for our records unless and until you ask us to delete it. Partner account information, payment records, and content submissions are retained for the duration of the partnership and afterward as needed for tax, accounting, and legal purposes.
We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons.
